1. Purpose

getmymoments.com (“the Platform”) operates connecting clients with independent photographers and providing booking, payment handling, editing, and digital delivery services. These General Terms apply to all users, services, and interactions unless supplemented by service-specific terms.

2. Platform Role

The Platform facilitates bookings, payments, editing, and delivery but does not physically participate in photoshoots. Photographers operate independently and are not employees, agents, or representatives of the Platform.

3. Services Overview

The Platform may provide:

  • Client generation and marketing

  • Booking and scheduling coordination

  • Payment processing

  • Image editing and digital delivery

  • Customer support

4. Payments & Pricing

Prices are displayed at checkout and apply to the selected service. Exchange rates, payment processor fees, card issuer fees, or third-party commissions are outside the Platform’s control and non-refundable.

5. Consumer Rights

Nothing in these Terms affects mandatory consumer rights that cannot be waived under applicable law.

6. Limitation of Liability

To the maximum extent permitted by law, the Platform shall not be liable for indirect, incidental, or consequential damages.

7. Data Protection

getmymoments.com acts as Data Controller. Service providers (including photographers) act as Data Processorssolely for the purpose of fulfilling booked services, in compliance with GDPR and applicable data protection laws.

8. Governing Law

These Terms are governed by the laws of the European Union where applicable, supplemented by the laws of the country in which the Platform’s operating entity is registered, without regard to conflict of law principles.

9. Updates

The Platform may update these Terms at any time. Updated versions apply to future bookings and services.

1. Service Nature
getmymoments.com acts as an intermediary platform connecting clients with independent photographers who provide photoshoot services in various destinations. All photographers work as independent contractors and are not employees or agents of getmymoments.com. The platform facilitates bookings, payments, and communication but does not assume responsibility for personal interactions or events occurring during the shoot.

2. Booking & Confirmation
A booking is confirmed once full or partial payment has been received and a confirmation email is issued. By confirming your booking, you agree to the service details, pricing, and policies stated at the time of reservation. All communication before the shoot is handled through the the platform’s Bookings Department until confirmation is complete.

3. Health & Safety
All photographers follow local laws and regulations, including COVID-19 or other public health guidelines in place at the time of service. Clients are responsible for complying with local safety requirements and maintaining personal safety throughout the session.

4. Late Arrivals
If you expect to be late, please notify your photographer at least one hour before your scheduled session. Without notice, photographers will wait up to 35 minutes from the agreed start time. Late arrivals may reduce total shooting time and cannot be extended unless the photographer chooses to do so at their discretion. No refunds or reschedules will be granted due to lateness.

5. Weather & Unforeseen Conditions
Photoshoots proceed under most weather conditions. Only if the photographer determines that weather or external factors make it unsafe or impossible to carry out the session will getmymoments.com offer a reschedule or full refund. Clients are encouraged to check local forecasts before booking.

6. Cancellations & Refunds
Cancellations made more than 8 weeks before the session are refunded minus a 15% administrative fee. After this period, bookings are non-refundable. Refunds, when applicable, are processed within 15 business days to the original payment method. No refund is provided for “no-shows” or same-day cancellations. Refunds are calculated based solely on the amount received by Travelandabroad.com and exclude any third-party processing fees, exchange differences, or commissions applied by external platforms.

7. Reschedules
If the client or photographer needs to reschedule, getmymoments.com will make reasonable efforts to arrange a new date. If rescheduling is not possible, the platform’s sole obligation is to provide a refund under the applicable cancellation policy.

8. Files & Editing
Photos are delivered via a digital gallery and remain accessible for 30 days from delivery. After this period, the gallery may be permanently deleted. Standard editing includes colour correction, exposure balance, and minor object removal. Additional or advanced editing (skin retouching, composite edits, or RAW files) may incur extra charges. File delivery timelines may vary depending on the photographer’s schedule, typically within 5-7 business days.

9. Intellectual Property & Usage
All photographs remain the intellectual property of the platform and are licensed to the client for personal, non-commercial use unless otherwise agreed in writing by the platform. Commercial usage rights may be granted through written permission and may incur an additional fee. Unless otherwise stated in writing, the platform grants the client and the photographer permission to use selected images for marketing, social media, and promotional purposes. Clients who do not wish their images to be used must email [info@getmymoments.com](mailto:info@getmymoments.com) prior to or immediately after the shoot.

10. Liability & Insurance
While every care is taken to deliver professional service, both getmymoments.com and its photographers are not liable for any personal injury, loss, theft, damage, or incident occurring during or after the session. In the event of equipment failure, illness, or force majeure (weather, accidents, travel restrictions, strikes, etc.), the photographer’s and platform’s maximum liability is limited strictly to a refund or, where possible, a rescheduled session. Neither getmymoments.com nor its photographers will be responsible for indirect, consequential, or incidental losses, including travel costs, missed connections, or opportunity losses. Clients are encouraged to hold personal travel or event insurance covering cancellations, weather disruptions, and property loss.

11. Taxes & Compliance
All payments are processed in accordance with applicable local and international tax laws. getmymoments.com operates as a registered business entity, and all photographers comply with their respective tax obligations in their country of residence. Invoices are issued digitally upon request.

12. Force Majeure
Neither getmymoments.com nor its photographers are responsible for delays or cancellations caused by events beyond reasonable control, including but not limited to natural disasters, severe weather, illness, flight cancellations, political unrest, or acts of government. In such cases, a credit or reschedule may be offered at the discretion of the platform.

13. Communication Policy
All official communication must occur through the platform’s channels (email, WhatsApp, or website chat). Direct contact with photographers before confirmation may not be available. Once the booking is confirmed, the photographer will contact you 24–48 hours prior to your session.

14. Data & Privacy
We respect your privacy. Personal data collected during booking is used solely for communication, coordination, and delivery of your session. We never sell or share your information with third parties and both platform and photographer comply with the GDPR laws.

15. Governing Law
These Terms are governed by and interpreted in accordance with the laws. In the event of a dispute, both parties agree to seek an amicable resolution before any legal action is taken.

16. Acceptance of Terms
By confirming your booking or engaging with our services, you acknowledge that you have read, understood, and accepted these Terms & Conditions in full.

The the platform provides services by connecting photographers with clients through its marketing and booking channels. The Platform manages bookings, payments, editing, and delivery. These Terms describe this relationship and apply to all services provided at all times.

2. Services Provided by the Platform

Generate clients through its own channels.

Manage bookings and client communications.

Collect and process client payments.

Edit and deliver final photos to clients.

Transfer the Photographer’s fixed payout for each confirmed shoot.

3. Role of the Photographer

Deliver photography sessions professionally, as agreed with the clients.

Provide the Platform with the photographs after each shoot, within 24 hours of completion, for editing and delivery.

Maintain high professional and quality standards.

4. Payments

The Photographer receives the previously agreed fixed payout per shoot with the Platform’s service fee (covering clients, editing, delivery, and support) already deducted.

Payout agreements may be updated in writing between the Platform and the Photographer, and such updates shall be considered applicable to all collaborations carried out with the Platform.

5. Independent Status

The Photographer is an independent professional, not an employee or subcontractor of the Platform.

The Platform does not purchase services from the Photographer. The Photographer engages the Platform’s services (marketing, client generation, editing, and payment handling).

6. Liability

The Photographer is solely responsible for conduct and performance during the shoot.

The Platform is not liable for the Photographer’s performance during the shoot.

The Platform’s responsibility is limited to generating clients, managing bookings, editing, and processing payouts.

7. Confidentiality & Data Protection

The Photographer must treat all client details as confidential, use them only to arrange and carry out the booked session, and never contact or reuse them afterwards without written consent from the Platform. This obligation follows GDPR and the Law on Personal Data Protection.

8. Acceptance

By carrying out any photoshoot or collaboration arranged through the Platform, the Photographer acknowledges and accepts these Terms & Conditions as governing all such work.

9. Term and Termination

These Terms remain valid until either party ends the collaboration with written notice.

The Platform may suspend or terminate collaboration immediately in the event of misconduct or breach of these Terms.

 

 

    1. Definition & scope

    The “Storefront” refers to a personalised sales page operated by photographers or creative partners on the Moments platform, a brand operated by Travelandabroad (“the Platform”). These Terms govern all services, purchases, and interactions made through a Storefront.

    2. Platform Role

    The Platform provides the technical infrastructure, payment processing, editing services (where applicable), and digital delivery. Storefront operators are independent professionals and are not employees, agents, or representatives of the Platform.

    3. Storefront Operator Responsibilities

    Storefront operators must:

    • Provide accurate service descriptions and availability

    • Deliver services professionally and on time

    • Upload all required files within the agreed timeframe

    • Comply with local laws, permits, and tax obligations

    4. Pricing & Payments

    All prices shown on a Storefront are set in accordance with Platform guidelines. Payments are collected by the Platform on behalf of the Storefront operator. Applicable Platform service fees, editing fees, or marketplace commissions are deducted before payout.

    Currency conversion rates, card issuer fees, and third-party payment charges are not controlled by the Platform and are non-refundable.

    5. Editing Services

    Unless explicitly stated otherwise, editing services are not included in Storefront bookings and must be purchased separately under the Signature Editing Services Terms.

    6. Cancellations & Refunds

    Storefront bookings follow the Platform’s general cancellation and refund policy unless a specific exception is clearly stated at checkout. The Platform retains final authority in dispute resolution and refund determinations.

    7. Client Relationship & Non-Circumvention

    Clients introduced through a Storefront remain Platform clients. Storefront operators may not redirect, solicit, or accept such clients outside the Platform for 12–24 months, depending on applicable law, without written authorisation.

    8. Intellectual Property

    All content uploaded to a Storefront (including images, text, branding, and portfolios) remains the property of the Storefront operator. By uploading content, the operator grants the Platform a non-exclusive, worldwide licence to display, promote, and distribute such content for marketing and operational purposes.

    9. Liability

    To the maximum extent permitted by law, the Platform is not liable for the performance of Storefront operators. Liability related to the service delivery rests solely with the Storefront operator and is limited to the remedies specified in the Platform’s refund policy.

    10. Suspension & Termination

    The Platform may suspend or remove a Storefront at any time in the event of:

    • Breach of these Terms

    • Misconduct or client complaints

    • Quality or compliance failures

    Termination does not affect completed or pending transactions.

    11. Data Protection

    The Platform acts as Data Controller. Storefront operators act as Data Processors solely for the purpose of fulfilling bookings and must comply with GDPR and applicable data protection laws.

    These Terms are governed by the laws of the European Union where applicable, supplemented by the laws of the Platform’s operating entity.

    13. Acceptance

    By creating, operating, or selling through a Storefront, the operator acknowledges and accepts these Terms in full.

    Signature Editing Services – Terms & Conditions

    Included vs. Optional Editing
    Signature Editing is automatically included for all photoshoots requested and booked directly by Travelandabroad.

    For any photoshoots originating from the photographer’s own storefront, private clients, or external business, Signature Editing is optional and subject to the terms outlined below.

    Service Scope
    Signature Editing is a professional post-production service provided exclusively for photographers. The service covers colour correction, exposure, tone, object/people removal and style consistency aligned with Travelandabroad’s high editing standards.

    Image Selection (Add-On)
    Image selection is not included by default. Photographers may either submit their own final selection or purchase the Selection Add-On, in which case Travelandabroad will perform the image curation based on quality, composition, and consistency criteria.

    Delivery Time
    Standard delivery time is up to 5 working days from the moment all required files and selections have been correctly submitted.

    Express Delivery (Add-On)
    An Express Delivery Add-On is available at checkout, providing priority processing and a reduced turnaround time up to 24hrs after submission.

    Revisions
    Minor revisions related to colour or exposure consistency are included. Requests that fall outside the original editing scope or require restyling may be treated as additional services.

    File Responsibility
    Photographers are responsible for submitting complete, correct, and accessible files. Delivery timelines begin only once all required materials are received.

    Relationship to Photographer Contract
    These terms apply solely to the Signature Editing Service and operate in conjunction with the existing Photographer Terms & Conditions. In case of overlap, the Photographer Contract remains the governing agreement.
